iPod Owner Sues Apple

Surprised and astonished are two words that would not describe my reaction to the news that a Louisiana man has filed a federal suit against Apple, claiming that the iPod is "inherently defective in design and are not sufficiently adorned with adequate warnings regarding the likelihood of hearing loss."

Long story short: he figures it's Apple's fault he doesn't know how to use the volume control. The best part? He's seeking class-action status for the suit, and there's no mention as to whether he's actually suffered any hearing loss.

I think there should be a vol limiter on the ipod it self, something you could turn off.

I am surprised and astonished that this even warrants a comment, much less a report. I reference the idiotic woman and court system that caused McDonalds to pay out a stupendous amount of money to her because she was so stupid she put hot coffee between her legs and scalded herself. Hot water is used to scald hogs and cause the hair to wipe off after you slaughter them and start processing them, duh!!!. If a company these days is stupid enough to produce or sell something like this without a volume limit that is safe, (in our entitlement obsessed country), maybe they should pay through the nose.

You a**holes still believe that McDonalds story? Do a little research and you'll find that the coffee was WAY too hot, even for "hot coffee", and Mcdonald's lawyers did not treat the kindly old lady very well in court. She deserved every little penny she got. STFU about it already.

El Mac is another one who formulates opinions based on emotion, rather than actual learning. The details of the McDonald's case include the fact that particular franchise had received numerous complaints from patrons that the coffee it was selling was _way_ too hot to justify with _any_ rationale. The management chose to ignore those legitimate complaints. So they paid for their disregard for customer safety. GOOD! We already had the world El Mac wishes for - it was called "the 1800's". After _enough_ people died due to corporate neglect, after _enough_ people ate sausage that included human parts and rat pieces (read "The Jungle". Ronald Reagan never would) - laws were enacted. Does Lee think restaurant coffee should double as the liquid used to scald the hair off hogs?!? How hot is THAT water? Covering for those who disdainfully ignore the heatlh and safety of their fellow citizens is not laudable; it's disgraceful.

I have come to the realization that people today have to blame someone else for the stupid decisions they make. Common sense is thrown away and entitlement has taken over. If I CHOOSE to do something without thinking first, I deserve to reap the consequences. Our own selfishness and actions govern the way society decides how much to award in civil cases. Everything we do affects everyone else directly or indirectly. Take responsibility for our own actions. Use your head for something besides a way to get over on the system.

Actually, from what I have read, earphones at a volume that can be heard at all by someone other than the wearer, even at the distance of only a few feet, can cause hearing loss. I doubt this fact is appreciated by anyone I have encountered that uses the things. I suspect what is needed is not a lawsuit, but regulation.

Sarge, you hit the nail in the head. We have lost independent thinking. It seems that we have to have the manufacturer tell us not to do something stupid. My wife bought a new clothes iron and in the instructions it reads, "do not iron clothes while wearing them". Holy Sh_t !! How stupid can someone be? Enough with this sue everyone because we as a society have no common sense. If you walk off the end of a roof it's not the ladder manufactures fault! It's yours. It's natures way of weeding out the idiots of the human race.

To all:

If we are now going to limit the amount of volume which can
be adjusted to what ever you want on an iPod, we should not
stop there! Alllll! Television sets, Hi - Fi equipment, radios,
Fm radios, car radios, All add,s on television, telephones,
Cell phones! This one for sure during any meetings
and when the dam thing go's off we all hear it!!
Movie Theaters, and all shows given in United States!

Now the people who can not hear very well, will suffer
big time! Let's do it to them!!!!

How stupid can u be. If its too loud turn down the volume! If the coffee was known to be hot let it cool off or test it like any sensable person. It is a sad day for America when people are rewarded for making stupid mistakes.
